The terms governing your use of the Pencilastic website, subscription, and learning platform.

1. Acceptance of these terms

These Terms & Conditions ("Terms") form a binding agreement between you and Melifluo ("Melifluo", "we", "us") with its place of business at Tower E, Flat 1309, Indis One City, KPHB-Hitech City Main Road, Near Malaysian Township, KPHB, Kukatpally, Hyderabad, Telangana 500072, India, governing your access to and use of the Pencilastic website, subscription, and learning platform (together, the "Service"). By ticking the agreement box and completing a subscription, or by using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & accounts (including minors)

The Service offers career-guidance learning content for school students, including those in Grades 8–10 who may be under 18. Under Indian law, a contract with a minor is not enforceable against the minor, and processing a child's personal data requires verifiable parental/guardian consent.

Accordingly, the person who subscribes, pays, and creates the account must be aged 18 or over and must be the parent or lawful guardian of the student (or the adult learner themselves). By subscribing, you represent that you meet this requirement and that you consent to these Terms on behalf of the student where the student is a minor. You are responsible for supervising the minor's use of the Service.

3. The service

The Service provides online access to career-guidance courses and related materials delivered through our learning platform. The Service is provided for personal, non-commercial, educational use. It is informational and does not constitute professional, financial, medical, legal, or definitive career advice, and we do not guarantee any particular academic, admission, examination, or career outcome.

Payments are collected through our third-party payment gateway, Razorpay. By paying, you also agree to Razorpay's applicable terms. We do not receive or store your card, UPI, or bank credentials (see our Privacy Policy). You agree to provide accurate billing information and that you are authorised to use the payment method. Access is granted once payment is confirmed as captured; in rare cases of delayed confirmation, access and your login details are provided as soon as the payment is confirmed, and any payment that does not complete is reversed by the gateway in the ordinary course.

6. Your account & acceptable use

You are responsible for keeping your login credentials confidential and for activity under your account. The account and course access are for the single subscribing learner and may not be shared, resold, or used by multiple users. You agree not to: copy, record, download (except where expressly permitted), redistribute, publicly display, or create derivative works from the content; circumvent access controls or share access; use the Service unlawfully or to infringe others' rights; or attempt to disrupt or gain unauthorised access to our systems.

7. Intellectual property

All content in the Service — including videos, text, graphics, course materials, the Pencilastic name, logo, and branding — is owned by or licensed to Pencilastic and is protected by applicable intellectual-property laws. Your subscription grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the content for your own educational use during your Subscription Period. No other rights are granted.

8. Cancellations & refunds

Because the Service provides immediate access to digital educational content, fees are generally non-refundable once access has been granted, except where required by applicable law or where we determine, at our discretion, that a refund is warranted (for example, a duplicate charge, or a failure on our side to provide access for which we cannot offer a remedy). To request consideration of a refund, contact us using the details in Section 14 with your order reference. Where a refund is approved, it will be processed to the original payment method via the payment gateway within a reasonable period.

9. Availability & changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free access; the Service may be unavailable for maintenance, updates, or reasons beyond our control. We may add, modify, or discontinue features or content from time to time. We will not reduce the core access you have already paid for during a Subscription Period without offering a reasonable remedy.

10. Disclaimers

To the maximum extent permitted by law, the Service and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. The content is educational and informational; decisions you make based on it are your own responsibility.

11. Limitation of liability

To the maximum extent permitted by applicable law, Pencilastic and its operators shall not be liable for any indirect, incidental, special, or consequential losses, or loss of opportunity, arising from your use of (or inability to use) the Service. Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid to us for the Subscription Period giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable Indian law.

12. Suspension & termination

We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. On expiry of a Subscription Period, course access is suspended (your learning progress is preserved so you can resume if you renew). You may stop using the Service at any time; as the subscription does not auto-renew, simply not renewing ends your ongoing access at the end of the paid period.

13. Governing law & disputes

These Terms are governed by and construed in accordance with the laws of India. Subject to any non-excludable consumer-protection rights, the courts at Mumbai, India shall have exclusive jurisdiction over any dispute arising out of or in connection with the Service or these Terms. The parties will attempt in good faith to resolve disputes amicably before resorting to litigation.

15. Changes to these terms

We may revise these Terms from time to time. The "Last updated" date reflects the current version, and material changes will be notified by reasonable means. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms, to the extent permitted by law.
